The California Department of Motor Vehicles (DMV) initially accused Tesla of misleading consumers through its use of the terms "Autopilot" and "Full Self-Driving" (FSD) in marketing materials. These terms were applied to Tesla's advanced driver-assistance systems (ADAS), which, while capable of aiding drivers in specific scenarios, still required active supervision and were not fully autonomous.
In July 2022, the DMV escalated the matter by filing a lawsuit against Tesla, asserting that the terminology created false perceptions about the vehicles' self-driving capabilities. An administrative law judge sided with the DMV, recommending a 30-day suspension of Tesla's dealer and manufacturer licenses in California. However, regulators opted to provide Tesla with a 90-day period to address these concerns. The DMV's actions emphasized consumer protection and accurate representation of technological capabilities, particularly in Tesla's largest U.S. market.
Tesla's Compliance and Marketing Changes
To comply with the California DMV's requirements, Tesla removed the term "Autopilot" from its marketing materials. The company also adjusted its descriptions of the "Full Self-Driving" (FSD) feature, explicitly clarifying that these systems still require driver supervision and are not fully autonomous. These changes aimed to align Tesla’s messaging with consumer protection laws and eliminate any misconceptions about its vehicles' capabilities.
The DMV acknowledged Tesla's efforts to address the outlined concerns, stating that the automaker had taken the necessary corrective actions to avoid suspension of its dealer and manufacturer licenses. DMV Director Steve Gordon remarked that Tesla’s compliance reflected a commitment to upholding regulatory standards. By implementing these changes, Tesla successfully navigated the regulatory challenge while maintaining its presence in California, a key market for electric vehicles.
