Intellectia is the data controller responsible for managing your personal information and is the exclusive owner of the Intellectia.ai website ("Website"), Intellectia mobile and desktop applications, Intellectia services (each, a "Service"), and all the information gathered on it. Intellectia collects information from users in various ways (further explained in this privacy policy).

This privacy policy applies to personal information that we collect from you when you visit this website, create an account, or use our applications or services ("you" or "your" being interpreted accordingly). Personal Information Collection

Information We Receive from You

User Accounts

Should you choose to create an account, you will need to supply us with certain personal information to provide you access to our additional services that benefit users. You may also opt to provide us with further information about yourself, as described below.

During registration, you will be required to provide us with either:

  • Your username, email address;
  • If you choose to register or log in using your account from a third-party service, such as Facebook, Twitter, Google, or Apple, we will collect the account information provided by that service.

In some instances, you may need to provide and verify your phone number. You can also add additional information about yourself in the profile settings; however, this is optional.

The following information will be publicly displayed:

  • username, the image you have chosen as your user avatar, signature, “About me”, Twitter handle, YouTube channel link, YouTube username, Facebook profile, Instagram profile, and website, date joined, subscription level.

The following information will not be publicly displayed:

  • your first and last name, phone number, and email.

If you register as a "Paid User", our third-party payment processor will also process information about your payment card and bank account information or payment account information that we require for the purpose of recording and processing your account registration. For further details, please refer to the point below titled "Payment Information," under the section headed "When We Share Your Personal Information."

We also process any personal information you choose to provide when corresponding with us by phone, email, or otherwise visiting and interacting with this Website or any other services we operate.

Service Information

When you use our service, you may provide us with your audio recordings (“Audio Recordings”), any text or images that you upload or provide to us in the context of the Services.

If you provide an Audio Recording, this may contain the personal information of third parties. Before you do so, please make sure you have the necessary permissions from your colleagues, friends, or other third parties before sharing personal information or referring them to us.

App Permissions

Our app requests certain permissions to function properly, including:

  • Camera: To allow you to take photos for profile pictures or content uploads. We will only access your camera with your explicit permission.
  • External Storage: To save downloaded content or access files. We will only access external storage with your explicit permission. This is necessary for saving and retrieving files such as images, documents, or other content you choose to upload or download within the app.
  • Network and Wi-Fi State: To check your device’s network connectivity and Wi-Fi status. This helps us ensure the app functions smoothly by confirming an active internet connection for features like syncing data or loading content.
  • Billing: To process in-app purchases or subscriptions. This permission allows our third-party payment processor to handle transactions securely when you opt for paid services.
  • Internet: To enable the app to connect to the internet. This is essential for accessing online features, syncing your data, and delivering real-time updates or content.
  • Notifications: To send you push notifications about app updates, new features, or social interactions. You can manage notification preferences in your device settings or within the app.
  • Phone State: To access basic device information, such as the device’s status, to optimize app performance and ensure compatibility. We do not use this permission to access your phone number or call logs.
  • Wake Lock: To keep the device awake during specific tasks, such as playing audio recordings or ensuring uninterrupted background processes. This ensures a seamless experience when using certain features.
  • Google Services: To integrate with Google services, such as analytics or push notifications, for improving app functionality and user experience. This permission allows us to communicate with Google’s servers for these purposes.
  • Dynamic Receiver Not Exported Permission: This is a system-level permission used to ensure secure communication between app components. It does not directly access your personal data but is required for the app to function properly on newer Android versions.
  • Contacts: With your explicit permission, our app may access your contacts to enable you to invite friends to join the service. We only access contacts when you grant permission through your device settings, and you can revoke this permission at any time.

We only request permissions that are necessary for the app’s functionality and do not use them for any other purposes. You can manage these permissions through your device settings at any time. If you deny certain permissions, some features of the app may not work as intended.

Cookies and Other Technologies

We use browser cookies (small text files placed on your device) to administer our site, gather and analyze statistical information, ensure security, combat spam, and for advertising purposes. Cookies enable us to provide you with an enhanced user experience when you browse our website and also help to improve its features. Log Files

We employ these log files to manage our site, gather aggregate traffic data for site planning, and to ensure compliance with our terms of service. It’s important to note that in these log files, IP addresses are not linked to personally identifiable information.

Device Information

We collect data about the devices you use to interact with our services, including the IP address of the device (which also gives us an indication of the country you are connecting from), the type of device, operating system, and versions of applications and browsers. This information is gathered to prevent spam and misuse of our services. In certain jurisdictions, IP addresses may be considered personal data and will be handled in accordance with this privacy policy.

Analytics

When you utilize our website, mobile and desktop applications, or widgets provided to other sites, we automatically gather analytics information. This may encompass general device details, device identifiers (such as Google Advertising ID for Android devices or Advertising Identifier (IDFA) for iOS devices), network information, and interactions with websites and applications. We collect data in a pseudonymous form, and this analytics information does not include any personally identifiable information from your profile. We use this data to analyze and enhance the functionality of our services and applications and to further develop and test our service. Data from Third Parties

When you log in to your account using credentials from internet services (such as Facebook, Twitter, Google, Yahoo!, LinkedIn, Apple), those services send us your username and the email address associated with the credentials you’ve used. We may also collect information from other third-party sources, such as marketing agencies, identity verification services, and analytics providers, which may include your name, contact details, and employer information where permissible under applicable law. We do not control or take responsibility for how third parties provide or process your personal information.

Usage of Personal Information

We utilize personal data in various ways that are essential for providing the services you intend to use, for certain legitimate interests, and as required to comply with applicable laws, as detailed below.

We do not typically rely on your consent to process your personal data if another lawful basis is available. If we do rely on your consent, we will clearly communicate this to you at that time, and you may withdraw your consent at any time by contacting us at privacy@intellectia.ai.

Profile

Each user’s profile comprises information detailing their viewing preferences. Settings for users (such as language, theme color, etc.) are maintained solely to customize the user’s experience when using our website, applications, or user accounts. We do not share private profile settings with any third parties.

Please be aware that when you create an account, other users or visitors may access your public profile and view any information you have made publicly available about yourself.

Operations Relating to User Accounts and Profiles

We use your contact information, such as your username, email address, or phone number, in the following ways:

  • To authenticate your user account, ensure its security and the security of our services, and to prevent spam, fraud, and abuse;
  • To acknowledge, confirm, and manage your user account;
  • To send all new users a welcome activation email to verify their email address;
  • (For Paid Users) To provide you with subscription services and contact you regarding your use of such services. This is necessary for us to fulfill your requests;
  • Paid Users will also receive a notification email from our payment processor if there are any issues with billing their cards for auto-renew subscriptions. Users cannot opt out of these messages, though they can delete their account.

Provide You with the Services

We use your audio recordings, usage information, and platform information in order to provide you with the Services.

We use information we automatically collect or generate about you when you use the Services, as well as non-personal information about your device such as device manufacturer, model, and operating system, and the amount of free space on your device, to analyze the use of and improve our Services.

Deleting User Accounts

You have the option to discontinue using our website and/or application and request the deletion of your account in the Profile settings. Your account will be deleted after 30 days. During this period, you can halt the deletion process at any time.

Please note that if you request the deletion of your account, we will remove the subsequent personal data you have provided us. Some data, such as published ideas and messages sent to other users, will be retained as they have already been integrated into our system. This data must be stored to maintain the integrity of the platform.

For legitimate business processes and to comply with legal obligations, including tax laws, audits, and security, we must retain certain data for an extended period. This data includes, but is not limited to, transaction logs, financial records, addresses, and employment details. The retention period for each type of data will adhere to specific legal requirements, extending up to 10 years.

Note that search engines and third parties may retain copies of your publicly available information even after your account has been deleted. Additionally, published ideas will remain on the site, and messages sent to other users cannot be deleted.

Marketing

We may send you marketing emails about products or services similar to those you are subscribed to, including information about events and other promotions we believe may interest you. This is unless you have indicated to us that you do not wish to receive such communications. We will send you other promotional information by email only with your consent, which was given when you provided us with your personal data. Users can opt out of receiving marketing communications at any time by clicking "unsubscribe" in one of the emails (for more information on your rights, please see the "Your Rights" section below).

Social Notifications

We may notify you via email about new users who have followed you, liked an idea, new ideas from users you follow, and so on. You can choose not to receive such notifications at any time by adjusting your Profile settings.

Service-Related Announcements

Occasionally, it may be necessary to send out service-related announcements. For example, if our service is interrupted for an extended period or a significant functionality upgrade is released, we might send all users an email message.

Customer Service

When you open a support ticket, we use your contact details, as well as information about your device, server logs, a description of the problem, and any other supporting materials (videos, screenshots, etc.), to help resolve the issue(s).

Legitimate Interests

We process your personal data as necessary for specific legitimate business interests, including but not limited to:

  • Responding to your inquiries, comments, or concerns;
  • Managing our services to understand how visitors interact with our Website and application, ensuring optimal presentation for you and your device;
  • Enhancing and refining our mobile applications;

Your Rights

  • Right to Rectification: If you believe that any personal data we hold about you is incorrect or incomplete, you have the right to request correction. You can update your profile information directly or contact us at privacy@intellectia.ai.
  • Right to Know About Data Sales: You have the right to know whether your personal data is being sold to third parties. As disclosed in this policy, we do not sell your personal data. Therefore, there are no sales of your data to report.
  • Right to Know About Data Sharing: You have the right to know whether your personal data is being shared with third parties. Details of our sharing practices are outlined in the "Sharing Personal Information" section below.
  • Right to Opt-Out of Data Sale: You have the right to opt-out of the sale of your personal data. Since we do not sell your personal data, the opt-out option for data sales is not applicable. However, see the "Opting Out of Data Sale or Targeted Ads" subsection below for instructions on opting out of targeted advertising.

Additional Rights for Specific Regions

  • California Residents (CCPA): Under the California Consumer Privacy Act (CCPA), you have the right to know what personal information is being collected, the right to request deletion, and the right to opt-out of the sale of your personal information. We comply with these rights as outlined in this policy. We will not discriminate against you for exercising your CCPA rights. In the past 12 months, we have collected personal information as described in the "Personal Information Collection" section and shared it as described in the "Sharing Personal Information" section.
  • Virginia Residents (VCDPA): Under the Virginia Consumer Data Protection Act (VCDPA), you have the right to access, correct, delete, and opt-out of the processing of your personal data for targeted advertising or sales. We ensure these rights are available to you as described.

We will process your request promptly and ensure that your data is not used for targeted advertising. Note that opting out of targeted ads does not mean you will stop seeing ads; they will simply not be personalized based on your data.

Do Not Track Signals

We do not currently respond to "Do Not Track" signals from web browsers, as there is no universal standard for interpreting these signals. However, you can manage your privacy preferences through your browser settings or by opting out of targeted ads as described above.

Sharing Personal Information

We share your personal data with third parties in the following scenarios, but we emphasize that none of these instances constitute a sale of your personal data. We do not receive monetary or other valuable consideration in exchange for your data:

  • Service Providers: Intellectia engages third-party service providers for operational support, such as payment processing, IT services, analytics, digital advertising, and marketing solutions. These parties may access, process, or store your personal data to perform services on our behalf, but they are contractually obligated to use your data only for the purposes we specify and in accordance with this policy.
  • Payment Information: Paid users must provide payment details for billing purposes, which are processed by our third-party payment processors. We do not access your payment card information during transactions. Contact information is used for communication if there are order processing issues.
  • Third-Party Content Providers: When you purchase market data, we share your contact details with providers like Refinitiv or stock exchanges, who process this data to grant you access.
  • Intellectia Affiliated Businesses: Our affiliates may access and process your information to provide requested services, offer products, and for the purposes outlined in this policy.
  • Analytics Providers: We use third-party analytics for our services and applications to monitor usage and improve functionality, such as Google Analytics.
  • Administrative and Legal Reasons: We may disclose your data if we believe it is reasonably necessary to comply with a law, regulation, legal process, or governmental request; to protect the safety of any person; to address fraud, security, or technical issues; or to protect our rights, property, or those of our users or affiliates.

Public Information on Our Site

Public Profile

When you create your profile on our Service, other users or visitors may access your public profile and see any information you have made available about yourself. Your email address, however, will not be visible (unless you choose to make it visible).

Public Content

Our Service allows those with a registered user account to share their chats, their ideas, and other content with the rest of the internet via our Publish features.

By using a Publish feature, you grant us an irrevocable, perpetual, and royalty-free license to publish and disclose the content, as well as the username of the author, which makes you identifiable.

You can also publish your content as "private." This means that the content will not be displayed publicly, nor will it be indexed by search engines.
